TERMS & CONDITIONS
Mahal Imagery LLC
RETAINER & PAYMENT
A non-refundable retainer of $1000 for weddings and/or 50% retainer for headshots, branding, or portraiture projects is required to reserve the session date. No date is secured until both the signed agreement and retainer are received.
The remaining balance is due in full 30 days for weddings, for headshots, branding, or portraiture projects on the day of prior to beginning the session. Failure to complete payment by this time may result in cancellation of services at the Photographer’s discretion, and all payments made will be forfeited.
RESCHEDULING
Rescheduling is permitted only if Mahal Imagery is available for the new requested date. Availability is not guaranteed.
If the desired date is already booked, Mahal Imagery is not responsible for securing a replacement date.
A reschedule fee may apply depending on timing and circumstances. All rescheduled events must take place within 365 days of the original event date.
CANCELLATION
All payments made are non-refundable.
In the event the Client cancels or chooses not to proceed with the event, Mahal Imagery is not responsible for fulfilling services on a future date unless agreed upon in writing.
EVENT COVERAGE & COOPERATION
The Client is responsible for providing an accurate timeline and ensuring cooperation from all parties.
Mahal Imagery is not responsible for missed moments due to:
- Delays in schedule
- Lack of cooperation from guests or vendors
- Venue or officiant restrictions
- Lighting limitations
- Weather conditions
CREATIVE CONTROL & EDITING STYLE
The Client acknowledges that they have reviewed Mahal Imagery’s portfolio and understands the artistic style, composition, and editing approach.
Photography is an art form, and final images are delivered consistently with Mahal Imagery’s signature style.
Mahal Imagery retains full creative control over:
- Image selection
- Editing decisions
- Color grading and retouching style
Requests for additional edits, alterations, or stylistic changes outside of the Photographer’s standard workflow may be declined or fulfilled at an additional cost.
IMAGE DELIVERY
Wedding galleries are delivered within 30–45 days.
A sneak preview may be delivered within 48 hours.
Portrait sessions are delivered within 2–3 weeks.
Delivery timelines may vary slightly during peak seasons but will always reflect a high standard of quality and care.
OVERTIME
Coverage beyond the contracted hours will be billed at the current hourly rate at the time of the event.
Overtime may be automatically applied if coverage extends beyond the agreed timeline and will be invoiced accordingly.
EXCLUSIVITY
Mahal Imagery shall be the sole professional photographer for the event. Any additional hired photographers must be approved in advance.
Guests may take photos, but must not interfere with key moments or professional coverage.
COPYRIGHT & USAGE
Mahal Imagery retains full copyright ownership of all images.
Clients are granted a non-exclusive license for personal use, including printing and sharing. Images may not be sold, altered, or used commercially without written consent.
MODEL RELEASE
The Client grants Mahal Imagery permission to use images from the event for portfolio display, marketing, social media, publication, and promotional purposes.
If the Client wishes to keep images private, a written request must be submitted prior to the event.
FAILURE TO PERFORM
In the unlikely event that Mahal Imagery is unable to perform due to illness, emergency, or circumstances beyond control, every effort will be made to secure a qualified replacement photographer.
If a replacement cannot be secured, liability is limited to a refund of payments made.
LIMITATION OF LIABILITY
Mahal Imagery is not liable for any indirect, incidental, or consequential damages.
In all cases, the maximum liability is limited to the total amount paid by the Client.
EXPENSES
The Client agrees to cover any necessary travel, lodging, parking, or related expenses if applicable. These will be discussed and agreed upon in advance.
MEALS [Weddings Only]
For events exceeding 6 hours, the Client agrees to provide a meal for the Photographer and any team members.
FILE STORAGE
Mahal Imagery will store final images for a limited time. The Client is responsible for downloading and backing up all files upon delivery.
GOVERNING LAW
This agreement is governed by the laws of the State of Florida.
